Terms of Service

These Terms of Service ('Terms') constitute a legally binding contract between you and Sezai Enes YILDIZHAN, an individual developer based in Turkey. By accessing or using Randez, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Section 1

Eligibility

  • You must be at least 18 years old to use the Service.
  • You must have legal capacity to enter into binding contracts.
  • You may not use the Service if previously banned or prohibited by law.
Section 2

Account Registration

  • You must provide accurate, current, and complete information.
  • You are responsible for maintaining credential confidentiality.
  • You are responsible for all activities under your account.
  • Notify support@randez.app immediately of unauthorized access.
  • I am not liable for losses from unauthorized account use.
Section 3

Description of Service

  • Online appointment booking and scheduling
  • Staff calendar and availability management
  • Automated email reminders (SMS coming soon)
  • Client check-in via QR code or booking code
  • Walk-in queue management
  • Business reports and analytics
  • Beta/preview features are provided 'as is' without warranty.
Section 4

Subscription and Payment

  • Plans: Free (limited), Professional, Business
  • Lemon Squeezy, LLC is the Merchant of Record for all payments.
  • Lemon Squeezy handles payment processing, taxes, and refunds.
  • Subscriptions renew automatically unless cancelled.
  • Price changes require 30 days' notice and apply at next renewal.
Section 5Important

Refund Policy

  • ALL SALES ARE FINAL. I do not offer refunds except as required by law.
  • EU/EEA consumers: 14-day cancellation right waived upon immediate access.
  • By using the Service immediately after purchase, you waive cancellation rights.
  • Lemon Squeezy may issue discretionary refunds to prevent chargebacks.
  • Chargebacks may result in immediate suspension and data loss.
Section 6

Cancellation

  • Cancel via account settings or support@randez.app.
  • Subscription remains active until end of billing period.
  • Data retained for 30 days after expiration.
  • After 30 days, data may be permanently deleted.
Section 7

Acceptable Use

  • Use only for lawful business purposes.
  • Do NOT: violate laws, harass others, distribute malware, spam, or gain unauthorized access.
  • Do NOT: scrape, reverse engineer, or circumvent security measures.
  • Do NOT: sublicense, resell, or redistribute the Service.
  • Violations may result in suspension or termination without refund.
Section 8

Your Data

  • You retain ownership of your content and data.
  • You grant me a limited license to store, process, and display your data.
  • For client data: You are Data Controller, I am Data Processor.
  • You are responsible for obtaining consent from your clients.
  • Data Processing Agreement per GDPR Article 28 is incorporated.
Section 9

Intellectual Property

  • The Service, code, design, and branding are my property.
  • You may not copy, modify, reverse engineer, or create derivative works.
  • Feedback you provide grants me a perpetual, royalty-free license to use it.
Section 10

Service Availability

  • NO UPTIME GUARANTEE OR SLA IS PROVIDED.
  • Service may be unavailable due to maintenance, infrastructure issues, or force majeure.
  • The Service depends on Supabase, Vercel, Scaleway, and Lemon Squeezy.
  • I am not responsible for outages caused by third-party providers.
  • I may modify or discontinue features with reasonable notice.

Disclaimers

  • THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND.
  • I disclaim warranties of merchantability, fitness for purpose, and non-infringement.
  • I do not guarantee uninterrupted, error-free, or secure operation.
  • The Service does not provide legal, medical, or financial advice.
Section 12Important

Limitation of Liability

  • I am NOT liable for indirect, incidental, special, or consequential damages.
  • I am NOT liable for loss of profits, revenue, data, or business opportunities.
  • TOTAL LIABILITY LIMITED TO: 12 months of payments OR $100 USD (whichever is greater).
  • These limitations are essential to the agreement and reflect risk allocation.
Section 13

Indemnification

  • You agree to indemnify and hold me harmless from claims arising from:
  • Your use of the Service
  • Your violation of these Terms or any law
  • Your violation of third-party rights
  • Your content or client data
  • Claims by your clients related to your use
Section 14

Dispute Resolution

  • Contact legal@randez.app for informal resolution (30 days).
  • Governing Law: Republic of Turkey.
  • Disputes resolved via binding arbitration at Istanbul Arbitration Centre (ISTAC).
  • Arbitration in Istanbul, Turkey, in English or Turkish.
  • CLASS ACTION WAIVER: Disputes resolved individually only.
  • EU consumers may use ODR platform: ec.europa.eu/consumers/odr
Section 15

Termination

  • You may terminate by cancelling subscription or contacting support.
  • I may terminate for: Terms violation, non-payment, fraud, abuse.
  • Upon termination: access ends, export data within 30 days, then deletion.
  • Survival: IP, disclaimers, liability limits, indemnification, dispute resolution.
Section 16

General Provisions

  • Entire Agreement: These Terms + Privacy Policy constitute full agreement.
  • Severability: Invalid provisions are severed; remainder continues.
  • No Waiver: Failure to enforce does not waive rights.
  • Assignment: You cannot assign; I may assign freely.
  • Force Majeure: Not liable for events beyond reasonable control.
  • Notices: Via email to your registered address.
Section 17

Changes to Terms

  • I may modify Terms at any time.
  • Material changes notified via email and on-site.
  • Continued use constitutes acceptance.
  • If you disagree: stop using Service, cancel subscription, delete account.
